Hi,

i texted Smolderforge 3 weeks ago. I spent almost 100€ for Donation and wanted to play.
But there is nobody to play ( maximum 100 players, maybe 150 on primetimeweekend - 10 of them playing arena )
or the Server is offline.

I bought this on the Internet, as far as i know france is in EU, so i have the right to get refund for onlinepurchases after 14 days.
I emailed you in time.

So why wont u answer my requests ?

I donated 100€ for a Server which i cant play on. Give me my money back!
There are EU-Rights for online purchases. Please Read !

I hope you react to this. If not, im forced to employ a lawyer, who will be paid by my legal costs insurance.

why should i be joking ?

If u buy a car, and it doesnt work. you want to give it back and get your money back right ?

What you do if the car sellsman ignores your request ? You get a lawyer.

The server is no longer located in France. We had a lot of issues out of our control with our host and were forced to move. You can play the server to find out how many people are online without needing to donate -- that is not a requirement. Buyer's remorse just isn't really an excuse here.

If you did contact us 3 weeks ago, that is 21+ days by the way. It's very clear what you donated for, and if you donated that amount of money you clearly knew and had experience with the server. You cannot go to the store and buy a bunch of stuff, return it days later because you don't want it anymore. Unless that store has a "money-back guarantee" which we do not because it's _very_ obvious and clear what you donated for.

Per our Terms of Service:
When you donate to Smolderforge, it is understood that you're actually "donating" at your own risk. Donation items are exclusively rewards for your consideration into donating to Smolderforge. You are not paying for any service, you are donating to keep our servers up. We are not selling virtual items. When you donate, you take the risk(s) involved in donating. All donations go for the maintenance, the website and servers. We are not to be held liable, or credit any refunds for any loss of rewards from donating for any reason. This includes loss of account(s) via account closures, account trading, sharing, etc.

You dont get the math.

I contacted you 3 Weeks ago => means you ignore my requests since 3 weeks.

i donated like 3 weeks and 3 days ago => means i reacted after 3 days.

i CREATED first account on smolderforge 3 weeks and 3 days ago.

im hard working software developer and i just wanted to play some world of warcraft. so i donated some money for items.
But i cant play on the server. So cant you understand that with an amount of 100€ and the ( lets be honest here ) bad service u provide ( 3 weeks no email answer ? ) that i want my money back ?

If you write like this, then be honest at least:

You dont give a fuck if i can play or not. All you care about is to KEEP the 100€.
You dont even considere a partial refund when it comes down to 100€.

Btw you can check all the numbers.

You can check that you didnt answer for 21 days.
You can check that i created first account and TRUSTED YOUR SITE ( 7 Years // many players // bla bla ) and donated for items shortly after.

And still you can understand why i feel scamed hard :D Are you serious ?

I really hope u will buy something one day and it just wont fuckin work and u wont get anything back. I really hope that.

Are you aware of this that you're not the only one who needs support and writes emails to Henry ?
He gets probably tons of mails daily.
So be patient, sooner or later you'll get what you've donated for.

You agreed to the Terms of Service upon account creation, that's the end of the story. We do not do refunds.

I'm sorry to hear you had a bad experience here, but as I said, most of these issues lately have been out of our control. You do not think that is stressful as well for me, as much as you? Of course that's not the service I want to provide. 150+ players is plenty to do battlegrounds, arena (2v2 and 3v3) and anything else pretty much. You cannot blame reasons you were aware of as reasons why you deserve a refund. It sucks you didn't like it here, I'm sorry to hear that, but that doesn't change the fact that you're not entitled to anything back. I suggest not donating to servers in the future if you want to be an Indian-giver and take it back.
