The reason is due to the way the current sanctuary flags work, not because I'm stupid, but because I actually know... The flags in the TBC core don't support hostile players in a sanctuary no matter what. You used to could duel in the mall, or I mean, start a duel. But once it began you both were friendly. Because of people stupidity we finally added a check to disable the starting of duels in the mall which prevented this issue. So the only way this will change is if we backport a lot of unneeded code to support that. Which I don't want as in Wrath it causes you to have to wait 20-seconds to logout, etc.
I've never been fond of cross-faction dueling. It takes away from PvPing outside city zones and simply homogenizes the server even further, yet you all ask for Horde and Alliance separation, that does not help.
