Potentially Dubious Gurubashi Mechanic

Let me start this of with saying that I know it is early days on the server and what I am reporting is not a massive deal. However I think it is something to look at in the future.
Early tonight there was a warlock who would stand at the edge of the raised section beside the teleport master and would apply dots to players in the arena. By standing on the very edge of the raised area they could not be attacked by melee of the same faction but could damage them with relative impunity.
I think it is one thing to head down the ramp or set a portal outside the arena, head down and dot people up and then run back into the same-faction safe zone. At least that way they can be attacked by melee of the same faction. However standing on the raised section they are effectively invulnerable.
(On live (tbc) servers I seem to remember there was a cooldown counter so if you ran into the arena and attacked someone for a certain period of time you were flagged to the same faction. A system like that would work better.
Anyway I feel locks are already strong in Gurubashi with demonic-portal and using this 'game mechanic' makes them immune to the same faction. The player in question defended the activity as a use of game mechanics. Could we maybe get clarification on this issue as to whether or not it is an acceptable form of pvp?

Note I didn't take any screenshots/footage because I think as a community such measures shouldn't be necessary with the vast majority of players, and also because it is not confirmed as cheating/abusing.
